Right Wing Viewpoint.
Professor McClanahan certainly knows his history and our constitution. However the US constitution was written in 1787 and ratified in 1788. That is 228 years ago. There is no way that the authors of this document could envision the world we live in today or even the world of even 1888. McClanahan believes that nine presidents have overstepped their legal authority and their actions have been unconstitutional. He acknowledges that most of these presidents have long been considered some of our "greatest" presidents, among them both Roosevelts and Abraham Lincoln. Where might our black population be without Lincoln's unconstitutional Emancipation Proclimation? Theodore Roosevelt, he claims, unconstitutionally began creating our National Park system. Perhaps that is true but most people today think that was a wonderful idea. That land, he infers, should be available to private enterprise, a typical right wing big business opinion. Refer to the book Dark Money. Franklin Roosevelt certainly did some unconstitutional things but, had he not, we would all probably be speaking German under a Nazi regime. Refer to the book Intrepid. Our present president, Barack Obama is on his list of the nine presidents who"screwed up" America. Perhaps we can understand our present situation. Note that McClanahan, says that most of the egregious act of these nine presidents either should not have been allowed by congress or that congress should have acted on these matters. However, we all know that our congress is bought and paid for by big money. And we all know that we are living with do-nothing congress as have been many other. How else could Obama have accomplished anything without stepping beyond constitutional authority as has been the case with the other nine presidents. Even his signature legislative act, the highly unpopular "Obamacare" package, is not as Obama wished because it was written by lobbyists for the drug industry, the insurance industry, the AMA and the American Bar Association. It is hard to really argue point by point in a review and this is all my opinion. However, we must understand my previous comment that the writers of the constitution could not have envisioned our present day world. The NRA has successfully convinced gun owners that they have a constitutional right to assault weapons. That is utter nonsense. The assault weapon of the time was a musket. Somehow we must be able to adjust the constitution to our modern world. Professor McClanahan, however correct, seems to have an axe to grind.
